Project Need


The client required environmental permits from the state of Tennessee – Division of Water Resources and Nashville District, US Corps of Engineers to make drainage culvert improvements. Additionally, state and federal watercourse jurisdictional determinations were required for environmental planning during site layout.

Services Completed


The project site contained several watercourses including one which contained a spring origin of an intermittent stream. Lord and Winter, LLC, conducted a site-wide hydrologic determination for state of Tennessee Waters of the State jurisdictional determination. A Nashville District, Corps of Engineers application was made under Nationwide Permit #3, Maintenance. Supporting the federal permit submittal was a Biological Assessment for consultation with the USFW Service; an endangered species review; a cultural resource assessment; and a state of Tennessee rare, threatened, and endangered species clearance submitted to the Tennessee Natural Heritage Program and the Tennessee Wildlife Resources Agency. An Aquatic Resource Alteration Permit (ARAP) application was made to the state of Tennessee – Division of Water Resources for 401 Water Quality Certification. A Waters of the State jurisdictional determination was requested through a Hydrologic Determination Report submittal by a state of Tennessee Qualified Hydrologic Professional.

Issue Resolved


As a result of the work by Lord and Winter, LLC, the client obtained a letter of concurrence from the state of Tennessee for watercourse jurisdictions, a 401 Water Quality Certification from the state of Tennessee – Division of Water Resources, and a Section 404 Permit from Nashville District – US Corps of Engineers.
