Project Need


A real estate development group sought to redevelop a former commercial property and required environmental investigations and liability protection through Tennessee’s Brownfield Voluntary Oversight and Assistance Program (VOAP). The site is planned for a multi-phase, mixed-use development featuring multiple towers with significant subsurface excavation.

Services Completed


Lord & Winter completed a comprehensive investigation, risk assessment, and remedial plan for the site. Work included:

  • A targeted subsurface investigation of former in-ground vehicle lifts to determine the presence of soil and groundwater contamination
  • Low-flow groundwater sampling to evaluate chloroform concentrations following a suspected leak
  • A site-specific, risk-based vapor intrusion assessment, developed using EPA guidance and updated groundwater data
  • Regular coordination with state regulatory staff to confirm technical approach and support the client's project schedule

As part of the Brownfield cleanup plan, Lord & Winter supports regulatory coordination, prepares key documentation (including the Brownfield Voluntary Agreement and Notice of Land Use Restrictions), manages permitting for solid waste and dewatering, and oversees well abandonment and site infrastructure disposal. Our goal is to guide the project toward a No Further Action letter from the state.

Issue Resolved


These investigations defined key exposure pathways and informed a risk-based remediation strategy. The findings equipped the development team to proceed with design planning while pursuing liability protection under the state’s Brownfield program.
