Project Need


A surface mining company acquired an existing, 252 acre, inactive, surface mine located along Mississippi Mile Marker 71.5. The acquisition required due diligence and environmental permitting to restart operations. An accelerated time table was required for compliance with the state of Missouri, Department of Natural Resources and US Corp of Engineers – St. Louis District requirements.

Services Completed


Lord & Winter, LLC facilitated compliance with state and federal environmental rules. A FOIA was requested and identified evidence of coverage of the loading area by Section 10 of the Clean Water Act administered by the US Corps of Engineers-St. Louis District. MSHA transfer of ownership forms was processed. Existing state of Missouri Air Quality and Stormwater Permits were transferred. The Mining, Land Reclamation Permit was applied for and received following Public Notice and Public Meeting. An updated SPCC Plan was prepared. A Phase 1 Environmental Site Assessment and a Phase 2 Soil Assessment were completed prior to acquisition.

Issue Resolved


As a result of the work the Cape Quarry, LLC has permit coverage of operations as issued from the state of Missouri, the US Corps of Engineers, and the Mine Safety and Health Administration (MSHA). The acquisition was successfully completed complying with innocent land owner requirements of CERCLA.
